Tracing the evolution of our present-day system, he gives us excerpts from the actual records of such trials as that of young William Penn, arrested for preaching Quaker beliefs in public; the Salem witch trials; and the landmark civil rights trial of 18th century newspaper publisher John Peter Zenger, whose attorney was the original "Philadelphia lawyer." Along with these famous courtroom episodes are many never before described in print, all of them infused with the drama that gives life to the law.

Dwyer's language is clear and engaging - a pleasant surprise for readers apprehensive about legal gobbledygook. He has a store of courtroom "war stories," some inspiring, some alarming, many enlivened by gleams of the author's wry humor.

Examining how judges go about making difficult decisions, Posner argues that they cannot rely on either logic or science, but must fall back on a grab bag of informal methods of reasoning that owe less than one might think to legal training and experience. Indeed, he reminds us, the greatest figures in American law have transcended the traditional conceptions of the lawyer's craft. Robert Jackson did not attend law school and Benjamin Cardozo left before getting a degree. Holmes was neither the most successful of lawyers nor the most lawyerly of judges. Citing these examples, Posner makes a plea for a law that frees itself from excessive insularity and takes all knowledge, practical and theoretical, as grist for its mill.

The pragmatism that Posner espouses implies looking at problems concretely, experimentally, without illusions, with an emphasis on keeping diverse paths of inquiry open, and, above all, with the insistence that social thought and action be evaluated as instruments to desired human goals rather than as ends in themselves. In making his arguments, he discusses notable figures in jurisprudence from Antigone to Ronald Dworkin as well as recent movements ranging from law and economics to civic republicanism, and feminism to libertarianism. All are subjected to Posner's stringent analysis in a fresh and candid examination of some of the deepest problems presented by the enterprise of law.]]>

Hirschman draws his examples from three successive waves of reactive thought that arose in response to the liberal ideas of the French Revolution and the Declaration of the Rights of Man, to democratization and the drive toward universal suffrage in the nineteenth century, and to the welfare state in our own century. In each case he identifies three principal arguments invariably used: (1) the perversity thesis, whereby any action to improve some feature of the political, social, or economic order is alleged to result in the exact opposite of what was intended; (2) the futility thesis, which predicts that attempts at social transformation will produce no effects whatever--will simply be incapable of making a dent in the status quo; (3) the jeopardy thesis, holding that the cost of the proposed reform is unacceptable because it will endanger previous hard-won accomplishments. He illustrates these propositions by citing writers across the centuries from Alexis de Tocqueville to George Stigler, Herbert Spencer to Jay Forrester, Edmund Burke to Charles Murray. Finally, in a lightning turnabout, he shows that progressives are frequently apt to employ closely related rhetorical postures, which are as biased as their reactionary counterparts. For those who aspire to the genuine dialogue that characterizes a truly democratic society, Hirschman points out that both types of rhetoric function, in effect, as contraptions designed to make debate impossible. Phillip Johnson's critique of Darwinian evolution touched off explosions among scientists and theologians almost from the day of its publication in 1992. The volatile debate was at first carried on in academic journals and in magazines like Nature and Scientific American. It even engaged the attention of leading evolutionists like Nobel Laureate physicist Steven Weinberg and prominent naturalist Stephen Jay Gould. Johnson was invited to debate several of his opponents at universities across the country.

And he was himself the subject of debate: Michael Ruse, author of Darwinism Defended, spoke at an annual meeting of the American Association for the Advancement of Science on the topic "Nonliteralist Anti-Evolutionism: The Case of Phillip Johnson."Darwin on Trial also shook up theistic evolutionists. William Hasker (Huntington College, Indiana) in the Christian Scholar's Review, Howard Van Till (Calvin College, Michigan) in First Things and Owen Gingerich (Harvard Center for Astrophysics) in Perspectives on Science & the Christian Faith all published their critiques of Darwin on Trial.

Clearly, Johnson's arguments have been taken seriously by Darwinists of every sort. And though at first the mainstream press seemed to be out of earshot (except for reviews in Publisher's Weekly and The National Review), news of Darwin on Trial eventually reached wider audiences.
